Mail-In Ballots/Protecting Voting Rights Talking Points BACKGROUND & CONTEXT • On August 18, 2025, President Trump announced his plan for an executive order (EO) to ban mail-in voting and eliminate voting machines, citing claims that mail-in ballots are “corrupt” and voting machines are “inaccurate and expensive.” • This proposal is an unlawful power grab, an unprecedented attempt to override state authority, and a direct assault on the freedom to vote. It is part of a larger trend by this administration to undermine democracy and civil rights by compelling states to hand over voter files and personal data, eroding local autonomy and stripping communities of their voice in decisions that shape their lives. TALKING POINTS • The proposed EO is unconstitutional. Constitutional authority for election laws lies with Congress and the individual states. The president does not have the authority to dismantle state election systems or to dictate how states run their elections. • Our governance structure is built on multiple systems of checks and balances. The executive branch doesn’t have the authority or the responsibility to dictate how or when states manage their electoral process under the law. Like with other executive orders he’s issued on voting, any attempt to strong-arm states into doing what he wants will almost certainly be litigated. • The implementation of this unlawful order would most certainly disenfranchise large swaths of legally qualified voters, especially Black, Latino, Native American, disabled, elderly, rural, and working-class voters, who already face multiple barriers to full participation. • The right to vote belongs to every American, regardless of party affiliation. A healthy democracy requires that every community has the ability to lawfully choose their representatives and to hold them accountable. • This order is designed to limit the right vote to a select, elite few. These unilateral, unlawful mandates are nothing more than thinly veiled attempts to undermine the rule of law and tamper with the basic tenets of our democracy. The order would add confusion, remove trusted options, and create new barriers to voting. States already administer elections with rigorous safeguards, including bipartisan oversight, audits, and legal remedies that ensure every ballot is counted securely. • Eliminating mail-in ballots is part of broader pattern of undermining democracy and consolidating power by undermining democratic norms, stripping states and communities of autonomy, and weakening democratic self-rule. • The administration has sought to compel states to hand over sensitive voter information and to expand unnecessary data sharing among federal agencies, raising the risk that such data will be weaponized to disenfranchise voters. o Using false claims of voter fraud, the administration is gaining access to state-held voter data that seeks to surveil and track targeted groups, including undocumented immigrants — but it will have consequences for citizens and noncitizens alike. o The administration is reportedly creating a master database that includes personally identifiable information from federal agencies and now state-held data including the Social Security Administration, the IRS, Medicaid, and other high-risk state data sources like voter rolls, arrest records, and child welfare information. • The facts are clear: Mail-in voting has been used securely and successfully in the United States for decades and remains a trusted method of voting in many states. Claims of widespread fraud have been repeatedly rejected by courts. This order is not based on evidence but on fear and misinformation designed to justify a dangerous power grab. • Mail voting is a secure, efficient method of voting used by voters of all ideological backgrounds. The history of mail voting reflects a bipartisan — and often Republican-led — commitment to providing voters with cost-effective, efficient, and user-friendly government solutions. Ballots are stored securely and handled under strict chain of-custody rules, sent only to registered voters whose identities are confirmed through state and federal databases. • Election equipment is safe, secure, and thoroughly tested at every stage of the process. Voting and tabulation machines aren’t connected to the internet, making remote tampering virtually impossible. o Equipment is locked, sealed, and monitored at all times, with strict chain-of-custody protocols documenting every handoff and post-election audits verifying results. Voter verified paper ballots provide a reliable backup, and all machines undergo rigorous testing by bipartisan teams both before and after elections. • Congress must step in to protect the freedom to vote by passing the John R. Lewis Voting Rights Advancement Act, the Freedom to Vote Act, the Native American Voting Rights Act, and legislation granting statehood to the District of Columbia. o These measures will prevent discrimination, protect equal access, and ensure that all communities can participate fully in the democratic process.
